Plaintiff brought this action seeking a deficiency judgment against defendants on a promissory note executed by defendant Air-Lift Associates, Inc., and guaranteed by the individual defendants. Defendants counterclaimed alleging unfair trade practices and breach of fiduciary duty. The plaintiff filed for a partial judgment on the pleadings seeking dismissal of defendants counterclaims. The trial court granted the plaintiffs motion. The defendants appealed. We affirm the trial courts dismissal of the counterclaims.
